These Terms of Service ("Terms") govern your access to and use of the Pinoy West website, forms, communications, interviews, matchmaking services, related consulting, K-1 visa support services, and any other related services offered by Pinoy West ("Pinoy West," "we," "us," or "our").
By accessing or using the website or services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use our services. By using Pinoy West, you represent that:
You are legally an adult in your jurisdiction
You have the legal capacity to enter into this agreement
The information you provide is true, accurate, and complete
You are using the services only for lawful purposes
2. Nature of Services
Pinoy West provides matchmaking-related services, screening, interviews, profile review, introductions, appointment scheduling, communications, educational materials, and related support. Certain optional services, including K-1 visa support or similar guidance services, may be offered separately.
We do not guarantee:
A match
A relationship
A marriage
A visa approval
Compatibility with any person
Ongoing communication from any applicant or match
Any specific outcome from use of the services
This is a service business, not a fairy godmother operation.
3. User Responsibilities
You agree to:
Provide truthful, current, and complete information
Use real, current photos that accurately represent you
Refrain from using AI-generated, fake, deceptive, or heavily misleading images
Behave respectfully toward staff, applicants, matches, and other users
Follow all screening, safety, and communication rules
Use the services only for serious relationship or marriage purposes if the platform is represented that way
Keep your contact information reasonably up to date
4. Prohibited Conduct
You may not:
Catfish, impersonate, or misrepresent your identity
Submit false or misleading personal information
Use AI-generated or fake photos as real identity photos
Ask for money, gifts, financial support, travel money, or favors early in communication in violation of platform rules
Harass, threaten, abuse, manipulate, coerce, stalk, or sexually pressure anyone
Attempt to bypass screening or safety procedures
Use the platform for scams, prostitution, trafficking, exploitation, or illegal purposes
Upload unlawful, offensive, defamatory, obscene, or infringing content
Interfere with the operation or security of the website or systems
Copy, scrape, harvest, or misuse content or data from the site
5. Screening and Approval
All applications, profiles, and services are subject to review, screening, and approval in our sole discretion. We may reject, suspend, restrict, or remove any applicant, member, user, or account at any time for safety, quality control, legal risk, dishonesty, policy violations, reputational concerns, or any other business reason.
Submission of a form does not guarantee approval.
6. Communications and Consent
By providing your contact information, you consent to receive service-related emails, calls, and messages reasonably necessary to process your application, schedule interviews, provide services, manage your account, and communicate next steps. If you separately opt in to marketing messages, you may also receive promotional communications.
7. Fees, Payments, and Refunds
Certain services require payment. By purchasing any service, you agree to pay the listed fees and any applicable taxes or charges.
Unless otherwise stated in writing:
Fees are non-refundable once services have begun, work has started, or access has been granted
We may refuse service, cancel services, or issue partial refunds in our discretion where appropriate
Payment disputes, chargebacks, or fraudulent payment activity may result in immediate suspension or termination
If you offer memberships, packages, or consultation services, additional written purchase terms may apply.
8. K-1 Visa and Related Support Disclaimer
Any K-1 visa or related immigration support provided by Pinoy West is for guidance, education, organizational support, and administrative assistance only unless explicitly stated otherwise in writing. Pinoy West is not a government agency, and unless specifically identified as such, is not acting as your attorney or law firm.
We do not guarantee visa eligibility, petition approval, embassy approval, interview success, immigration outcomes, or government processing times.
Users are responsible for verifying official requirements and obtaining licensed legal counsel when needed.
9. Matchmaking Disclaimer
Pinoy West does not guarantee that any introduction will lead to communication, compatibility, exclusivity, dating, engagement, marriage, or any other desired result. Human beings are unpredictable. That has been true since the dawn of time and the internet did not fix it.
You are solely responsible for your personal decisions, communications, travel, safety precautions, and relationship choices.
10. User Content
By submitting photos, profile information, written responses, testimonials, reviews, or other content, you represent that you have the right to provide such content and that it does not violate any law or third-party rights.
You grant Pinoy West a non-exclusive, worldwide, royalty-free license to host, store, use, reproduce, process, and display such content as reasonably necessary to operate the services, conduct screening, provide matchmaking, and manage the business.
11. Safety and Personal Risk
You acknowledge that interactions with other people involve inherent personal risk. Pinoy West is not responsible for the actions, statements, conduct, omissions, background, intentions, criminal history, honesty, or behavior of applicants, matches, members, or third parties.
You are responsible for taking reasonable safety precautions in all communications, meetings, travel, and relationship decisions.
12. Intellectual Property
All website content, branding, copy, logos, designs, service materials, workflows, educational resources, and related content are owned by or licensed to Pinoy West and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or exploit our materials without permission.
13. Disclaimer of Warranties
The website and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.
14. Limitation of Liability
To the fullest extent permitted by law, Pinoy West and its owners, officers, members, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or speculative damages, or for any loss of profits, opportunities, data, goodwill, relationships, or expected outcomes arising from or related to the use of the website or services.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to the services will not exceed the amount you paid to us for the specific service giving rise to the claim in the 3 months preceding the event.
15. Indemnification
You agree to defend, indemnify, and hold harmless Pinoy West and its owners, officers, members, employees, contractors, affiliates, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the services, your content, your conduct, your violation of these Terms, or your violation of any law or third-party rights.
16. Termination
We may suspend or terminate access to the website or services at any time, with or without notice, for any reason, including suspected fraud, safety concerns, non-payment, abuse, dishonesty, legal risk, or policy violations.
Sections that by their nature should survive termination will survive termination, including payment obligations, disclaimers, limitations of liability, indemnification, dispute provisions, and intellectual property protections.
17. Governing Law
These Terms are governed by the laws of the State of Floride, without regard to conflict of law principles.
18. Dispute Resolution
Any dispute arising out of or relating to these Terms or the services will first be attempted to be resolved informally by contacting us.
If not resolved informally, any dispute, claim, or controversy may be resolved exclusively in the state or federal courts located in Orange County,Florida and you consent to personal jurisdiction and venue there, unless a different dispute process is required by applicable law or separately agreed in writing.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
20. Entire Agreement
These Terms, together with any additional policies, payment terms, or written service terms expressly incorporated by reference, constitute the entire agreement between you and Pinoy West regarding the website and services.
